1. Acceptance of Terms

By accessing or using the website lexwiser.in (the "Website"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, please stop using the Website immediately. Continued use of the Website following any update to these Terms constitutes your acceptance of the revised Terms.

These Terms constitute a legally binding agreement between you and LexWiser ("we", "us", "our") under the Indian Contract Act, 1872.

2. About LexWiser

LexWiser is a legal services practice based in Delhi, India. All advocates associated with LexWiser are enrolled with the Bar Council of Delhi and practise under the Advocates Act, 1961 and the Bar Council of India Rules, 1975.

3. Use of the Website

The Website is intended for individuals and businesses seeking general legal information or wishing to explore engaging LexWiser for legal services. You may use the Website only for lawful purposes and in accordance with these Terms.

By using this Website, you represent and warrant that:

• You are at least 18 years of age or accessing the Website with the consent of a parent or guardian.
• You have the legal capacity to enter into a binding contract under Indian law.
• All information you provide through the Website (including contact forms) is accurate and complete.
• Your use of the Website does not violate any applicable law, regulation, or court order.

4. Prohibited Uses

You must not use this Website in any manner that:

• Violates any applicable Indian or international law or regulation, including the Information Technology Act, 2000, the Telecom Act, 2023, or the Bharatiya Nyaya Sanhita, 2023 (BNS) and rules made thereunder.
• Transmits or facilitates the transmission of any unsolicited commercial communication, which may constitute an offence under the Telecom Act, 2023 and TRAI regulations on unsolicited commercial communications.
• Involves impersonating any person or entity, or misrepresenting your affiliation with any person — which may constitute an offence under Section 319 (cheating by personation) of the BNS, 2023.
• Involves uploading or transmitting any viruses, malware, ransomware, or other harmful or malicious code, which constitutes a cyber offence under the IT Act, 2000 and applicable provisions of the BNS, 2023.
• Attempts to gain unauthorised access to any part of the Website, server, database, or connected systems — an offence under Section 66 of the IT Act, 2000.
• Scrapes, harvests, or collects personal data or other information from the Website using automated tools, bots, or scripts, which may constitute a violation of the Digital Personal Data Protection Act, 2023 and the IT Act, 2000.
• Reproduces, duplicates, distributes, or exploits any content from the Website for commercial purposes without our express written permission.
• Interferes with or disrupts the integrity, performance, or availability of the Website or its underlying infrastructure.
• Uses this Website to publish or transmit content that is defamatory, obscene, or harmful to minors — offences under the BNS, 2023 and the Protection of Children from Sexual Offences Act, 2012 (POCSO).

5. Legal Services — Engagement and Fees

The Website provides information about our legal services and allows you to submit enquiries. However, submitting an enquiry or booking a consultation does not by itself create a contractual obligation on either party to proceed with an engagement.

A formal attorney-client relationship with LexWiser is only established when:

• We have completed our conflict-of-interest checks and accepted your matter.
• You have received and signed a written engagement letter or retainer agreement.
• The applicable fees and scope of work have been mutually agreed upon in writing.

All fees for legal services are communicated prior to engagement and are exclusive of applicable taxes (including GST) unless stated otherwise. Fees once paid are non-refundable unless otherwise agreed in the engagement letter or required under applicable law.

6. Intellectual Property

All content on this Website, including but not limited to text, graphics, logos, icons, images, blog articles, service descriptions, and downloadable materials, is the intellectual property of LexWiser and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable Indian intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Website for personal, non-commercial purposes only. This licence does not permit you to:

• Reproduce, distribute, or publicly display any content from the Website without our prior written consent.
• Modify, adapt, translate, or create derivative works based on Website content.
• Use any of our trademarks, trade names, logos, or branding without our prior written consent.

Any unauthorised use of content from this Website may give rise to a claim for damages and may also constitute a criminal offence under applicable law.

7. User Submissions

When you submit information through our contact form, book a consultation, or otherwise communicate with us through the Website, you acknowledge that:

• The information you provide will be processed in accordance with our Privacy Policy.
• No attorney-client relationship is established merely by submitting an enquiry or receiving an initial response from us.
• Information shared prior to a formal engagement is not protected by attorney-client privilege.

8. Consumer Rights

LexWiser is committed to providing transparent and fair services in compliance with the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020. As a consumer, you have the right to:

• Receive clear, accurate, and complete information about our services, fees, and terms before engaging us.
• Withdraw from a consultation or preliminary enquiry at any time before a formal engagement letter is signed, without liability.
• Raise complaints or grievances through our designated Grievance Officer (see Section 16 below) within a reasonable time of the incident.
• Seek resolution of disputes through consumer forums established under the Consumer Protection Act, 2019, where applicable.
• Not be subjected to unfair trade practices or misleading representations as defined under the Consumer Protection Act, 2019.

Nothing in these Terms limits or excludes any rights you have as a consumer under applicable Indian law that cannot be waived by agreement.

9. Disclaimer of Warranties

The Website and all content on it are provided on an "as is" and "as available" basis without any representations or warranties of any kind, whether express or implied.

To the fullest extent permitted by applicable law, LexWiser disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• That the Website will be uninterrupted, error-free, or free from viruses or other harmful components.
• That information on the Website is accurate, complete, current, or applicable to your specific situation.

This does not affect any statutory rights you may have as a consumer under Indian law.

10. Limitation of Liability

To the fullest extent permitted by applicable law, LexWiser and its associated advocates shall not be liable for any loss or damage of any kind arising out of or in connection with:

You agree to indemnify, defend, and hold harmless LexWiser and its advocates, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Website, your violation of these Terms, or your infringement of any third-party rights.

The Website may contain links to third-party websites and resources including government portals such as MCA21, IP India, and the GST Portal. These links are provided for your convenience only. LexWiser does not endorse or take responsibility for the content, accuracy, or practices of any third-party website. Your use of any third-party website is governed by that website's own terms and policies.

13. Privacy and Data Protection

Your use of this Website is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal data. LexWiser acts as a Data Fiduciary as defined under the Digital Personal Data Protection Act, 2023 (DPDP Act) and the Digital Personal Data Protection Rules, 2025 (DPDP Rules).

In compliance with the DPDP Act and DPDP Rules, we:

• Collect personal data only for specified, clear, and lawful purposes with your prior free, specific, informed, and unambiguous consent (Section 6, DPDP Act).
• Retain personal data only for as long as necessary for the stated purpose, after which it is erased (Section 8(7), DPDP Act).
• Do not transfer personal data outside India except to countries permitted under Section 16 of the DPDP Act and as notified by the Central Government.
• Take reasonable security safeguards to prevent personal data breaches (Section 8(5), DPDP Act). In the event of a breach, we will notify the Data Protection Board of India and affected individuals as required.
• Do not knowingly collect or process personal data of children under 18 years without verifiable parental consent, in accordance with Section 9 of the DPDP Act.

14. Your Rights as a Data Principal

Under the DPDP Act, 2023 and DPDP Rules, 2025, you (as a "Data Principal") have the following rights with respect to your personal data held by us:

• Right to Access (Section 11): You may request a summary of personal data we hold about you and the purposes for which it is being processed.
• Right to Correction and Erasure (Section 12): You may request correction of inaccurate or outdated personal data, and erasure of data where the purpose for which it was collected is no longer being served.
• Right to Grievance Redressal (Section 13): You may raise a complaint with our Grievance Officer (see Section 16). If dissatisfied with the resolution, you may approach the Data Protection Board of India.
• Right to Nominate (Section 14): You may nominate another individual to exercise your data rights on your behalf in the event of your death or incapacity.
• Right to Withdraw Consent (Section 6): You may withdraw consent for processing at any time. Withdrawal of consent will not affect the lawfulness of processing prior to withdrawal, but may limit our ability to provide certain services.

To exercise any of these rights, please contact our Grievance Officer at grievance@lexwiser.in. We will respond within the timelines prescribed under the DPDP Rules, 2025.

15. Amendments to These Terms

LexWiser reserves the right to revise and update these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. We encourage you to review these Terms periodically. Your continued use of the Website after any changes are posted constitutes your acceptance of the updated Terms.

16. Grievance Officer

In accordance with the Information Technology Act, 2000, the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Digital Personal Data Protection Act, 2023, the DPDP Rules, 2025, and the Consumer Protection Act, 2019, a Grievance Officer has been appointed to address complaints and concerns regarding this Website and our data practices:

If you are not satisfied with the resolution provided by our Grievance Officer, you may escalate your complaint to the Data Protection Board of India (for data protection matters) or to the appropriate consumer forum under the Consumer Protection Act, 2019.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of India, including the Indian Contract Act, 1872, the Consumer Protection Act, 2019, the Bharatiya Nyaya Sanhita, 2023, and the Digital Personal Data Protection Act, 2023.

Any dispute, controversy, or claim arising out of or in connection with these Terms or your use of the Website shall first be subject to good-faith negotiations between the parties. If the dispute is not resolved within 30 days of written notice, it shall be subject to the exclusive jurisdiction of the courts in Delhi, India.

Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a competent court, or from exercising statutory rights before the Data Protection Board of India or applicable consumer forums.

18. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and LexWiser with respect to your use of this Website and supersede all prior or contemporaneous communications, representations, or agreements relating to that subject matter.
